      In the Name of God Amen I Joseph Cumberbirch of the Hough in the Parish of Wilmslow and County of Chester Yeoman being of sound and disposing mind and memory praised be God for the same, do make this my last Will and Testament in manner and form following that is to say First I will and direct that all my just debts, the Funeral Expences and the charges pf the Probate of this my Will be truly paid. And I give and devise unto and to the use of my Two Sons James and William their Executors administrators and assigns all my Freehold and Leasehold property situate in the Parish of Wilmslow aforesaid with all the appurtenances thereto belonging upon the Trusts nevertheless, and to and for the several intents and purposes hereinafter expressed declared of and concerning the same that is to say upon Trust for my Wife Sarah Cumberbirch to have the full use and enjoyment of the Interest and profits arising from and out of my Estate and after her decease, then I will and direct further for all my household Goods and Furniture Farming Stock and Implements in husbandry be sold by Public Auction and the Money arising therefrom to be equally divided share and share alike unto and amongst my Four Sons John, James, William and Thomas and all my remaining Property Freehold and Leasehold I hereby direct that my said Trustees with all care from and out of the rents and profits arising therefrom do accumulate a Fund for the purposes of defraying and clearing off the debts oweing thereon, and as soon as this is done then I will and direct the same Freehold and Leasehold if not dropt [dropped] out of Lease to be sold either by private or by public Auction which may be thought best at the time, and the Money arising therefrom I give devise and bequeath as follows, to Joseph Snape son of my Daughter Sarah the sum of Fifty Pounds, to William Walker Son of my Daughter Elizabeth the sum of Fifty Pounds to be paid to them on their severally attaining the age of Twenty One Years the same to be divided equally share and share alike amongst my said Children hereafter mentioned, all the rest and remaining part I give and devise equally share and share alike unto my Sons and daughters namely James, William, Thomas, John, Ann, Jane and Martha if living at the time save and except One Hundred Pounds to be deducted from and out of my Daughter Ann’s share which she as [sic has] had already, and if any of my said children shall happen to die leaving lawful Issue or Issues such child or children’s share to be divided equally to his or her children so dying as they attain the ages of Twenty One Years. And I do nominate, constitute and appoint my said Sons James and William Executors of this my last Will and Testament hereby revoking and making void all and every other Will or Wills at any time heretofore by me made, and do declare this to be my last Will and Testament. In Witness whereof I the said Joseph Cumberbirch have hereunto set my hand and seal this Second day of December, in the Year of our Lord 1836 [2nd Dec 1836]

      The 15th day of May 1845 James Cumberbirch one of the Exec[uto]rs in this Will named was sworn in common form (power being reserved to William Cumberbirch the other Exec[uto]r therein also named to take upon him the Exec[utio]n of the said Will when he shall lawfully request the same) and he further made oath that the personal Estate & Effect of the Testator within the Diocese of Chester was under the value of Two Hundred Pounds before me Wm Cruttenden AM Surrogate
      The Testator died the 3rd day of February 1845
