      In the name of God Amen I James Comberbach of Namptwich in the County of Chester Tanner being sick of body butt of Perfect Mind and Memory Praise be therefore Given to Almighty God doe make and Ordaine this my last Will and Testament and doe hereby Revoke all former Wills by me made.

      Impris I Comend my soul to God my Maker hopeing through the Merritts of Jesus Christ my Saviour to be made Partaker of Everlasting Life and my Body I Comitt to the Earth whereof itt was made. And as to the Disposition of such Worldy Estate as itt has Pleased Almighty God to Bless me with I Give and dispose thereof in Manner following first I will that my Debts and funerall expences shall be paid and discharged. And whereas I have already given to Roger Comberbach Esquire my Eldest Sonn my Interest in Certaine Lands of One Hundred Pounds pAnnum And all such Legacies that he had Left him by any Relations without taking any part of his wife’s Marriage Porcon I doe therefore hereby Give and Bequeath unto his four Children my Grandson Roger and my Grand-Daughters Elizabeth, Jane and Alice the Sume of Tenn Pounds A Peece.

      And I doe hereby Give and Bequeath and Devise unto my Sonn John Comberbach All those Messuages or Dwellin houses with their Appurtenances And the Kill with itt’s appurtenances and the Lands thereunto belonging scituate (sic) and being in Barker Street in Namptwich aforesd late the Inheritance of Mr John Crew deceased To hold the same to him my sd Sonn John and his heirs for Ever Provided he pay’s to my Executors hereafter named the Sume of Three Hundred Pounds within One Month after my Decease.

      And I doe hereby Give and Bequeath unto my sd Sonn John the Sume of Two Hundred Pounds which hee Oweth mee by Bond with what Interest shall then be due upon the same all the time of my Death.

      Item I Give and Bequeath unto my sd Sonn John and his issue my Interest during the Lease of and in those Two fields with the Barne thereupon standing and One Meadow lying near Shrow: Bridge in the sd County of Chester being the Inheritance of Richard Walthall Esquire. And forwant of Issue I give the same unto my Sonn James and Daughter Jane and Daughter Dorothy and their issue to be Equally Divided Amongst them.

      Item. I Give and Bequeath unto my Sonn James Comberbach the Sume One Thousand Pounds.

      Item. I Give and Devise unto my sd Sonns John Comberbach and James Comberbach All that my Messuage and Tenement with the Lands thereunto belonging scituate (sic) and being in Coppenhall in the sd County of Chester and all my Interest therein late the Inheritance of Phillip Chetwood Esquire deced and also my house with itt’s app’ tences wherein I now Inhabitt and Dwell which I Bought of Richard Lister Esqre To Have and to hold the same Tenement my said Dwelling house and premisses unto my sd Sonns John Comberbach and James Comberbach their heirs and Assigns for Ever.

      Item I Give and Bequeath to my Daughter Dorothy Comberbatch her Executors Aministrators and Assigns all my Interest in A Certaine Annuity or Yearly Rent Charge of Twenty Pounds which I have lately Bought from John Smith and Issueing out of A Certaine Tenement in Huxley? in the sd County of Chester during my whole Terme therein And I doe likewise give and Bequeath to my sd Daughter Dorothy the Sume of Two Hundred Pounds Provided shee Marry with the Consent of my sd Sonn Roger Comberbach. Butt if shee Marry without the Consent of my sd Sonn Roger then my Will and Mind is that my sd Sonns Roger and John shall Dispose of the sd Two Hundred Pounds as they shall think Conevient for the use of her and her Children and for want of such Children I Give the same unto my sd Sonns John and James and Daughter Jane Hawkins and their issues to be Equally Divided Amongst them.

      Item I Give and Bequeath to my sd Daughter Dorothy the Sume of Twenty Pounds in Lieu of A Bride Cart.

      Item I Give to my Daughter Jane Hawkins the Goods I Lent her since her Marriage.

      Item my Will and mind is that my sd Sonns Roger and John shall sett out to Interest One Hundred Pounds the Product whereof I Give to my sd Daughter Jane Hawkins and her Assigns during her natural Life. And after her Death and Decease then my will and Mind is that the Sume of Fifty Pounds being halfe of the Principle [Principal] Mony (sic) shall be paid to my GrandChild and Godsonn (sic) James Hawkins and the other fifty Pounds to be divided Amongst the Younger Chilren of my sd Daughter Jane Hawkins.

      Item I Give to the Minister for Preaching my funerall Sermon Twenty Shillings and to my Cozen [Cousin] Mr Samuel Hussey if he be then Clarke Tenn Shillings and to my Cozen Mary Clowes Widd Tenn Shillings. And to my Sisters three Children to witt to Mr John Tench of London Twenty Shillings and to his wife Tenn Shillings and to Elizabeth Tench his Sister Tenn Shillings and to his Sister Jane Tenn Shillings. And to Mr Hugh Delves Tenn Shillings and to my Cozen Mr Mathew Meakin Tenn Shillings. And to Alice my Sonn Roger’s wife A Ring that is by me and to Elizabeth my Sonn John’s wife A Ring that is by me. And to my Daughter Dorothy A Ring that is by me, which maketh the Three Rings by me. And to Mr John Tayler of Namptwich aforesd Stationer Tenn Shillings.

      Item I Give to my Old Servants to Joseph Egerton forty Shillings. And Ralph Hassall forty Shillings. And to my hired Quarterly, or Yearly Woman or Maid Servant that shall belong to my house att the time of my Decease the Sume of Twenty Shillings and my Morning Gowne. And I doe hereby nominate and Appointe My sd Three Sonns Roger Comberbach Esqre John Comberbach and James Comberbach Executors of this my last Will and Testament. And doe Give unto my sd Sonn Roger Comberbach Tenn Pounds and to my Sonn John five Pounds and to my Sonn James five Pounds. And to my Old Servant John Hobson four Pounds for his Assistance to my Executors in Executing this my last Will and Testament. And if itt happen that Joseph Egerton Ralph Hassall and John Hobson or any of them Dye before me then the Legacies hereby given to any of them shall be given to such of their Children as I was Witness to in their Baptisme.

      And my Will and Mind is further that my sd Sonn James shall give A Release unto my other Executors of and from all Legacies Left and Given him by his GrandMother Comberbach and my Uncle Mr Roger Comberbach both Deced which Legacies I have Reced Butt if he Refuse to doe itt my Will is, the like value shall be deducted out of his aforesd Legacy of One Thousand Pounds hereby given him. And whereas my sd Sonn Roger Comberbach stands Bound with me in a Certaine Bond of the Penalty of Six Hundred Pounds to Mr Joseph King of the Citty of London with whom my sd Sonn James is now Apprentice with condicon that my sd Sonn James shall be true and faithfull to his sd Master during the time of his sd Apprenticeship now if my sd Sonn Roger Comberbach his Executors or Adminers shall Come to any Damage by Reason of the sd Bond my Will and mind is that then he or they that shall be soe Damnifyed shall be Indemnifyed and saved harmeless of and from the same out of the sd Sume of One Thousand Pounds hereby given to my sd Sonn James and nott out of any other part of my Estate. And if itt happen that my personall Estate shall fall short to discharge the Legacies hereby given My Will and Mind then is that they shall be paid out of the Legacies hereby given to my sd Sonn John and Sonn James Butt if there be any Overplus then my Will and Mind is And I doe hereby Give Devise and Bequeath All the Rest Residue and Remainder of my Goods Chells and Personall Estate unto my sd Sonns John Comberbach and James Comberbach to be Equally Divided betwixt them. And I doe nott at all Doubt butt my sd Executors and Trust will see this my Last Will and Testament punctually performed as before is Declared and itt is my Desire that nore difference may Arise about the same. In Witness whereof I the sd James Comberbach have hereunto sett my hand and seale this fifth day of October in the Year of our Lord One Thousand Six Hundred Nynety and Six.
