      This is the last Will and Testament of me James Cumberbirch of Congleton in the County of Chester Breeched-maker And first I direct all my just Debts (except a Debt of One hundred Pounds which I owe on Mortgage of my real Estate) and Funeral Expences to be paid and satisfied by my Executors hereinafter named out of my personal Estate. I give and devise All those my Messuages or Dwelling Houses with all and singular the Buildings Gardens Hereditaments and Premises with their Appurtenances situate and being in and near to High Street in Congleton aforesaid and all other my real Estate whatsoever and wheresoever unto my dear Wife Catherine Cumberbirch To hold and enjoy the same and to have receive and take the Rents Issues and Profits thereof for and during the Term of her natural Life she keeping all the said Hereditaments and Premises in good repair and condition and also paying the Interest of the said sum of one hundred pounds so owing on Mortgage as aforesaid when and as often as the same shall become due which said Principal sum of One hundred pounds (if not paid off in my Life time) I direct shall not be discharged until after my said Wife’s Deceased unless she think proper so to do. Also I give and bequeath unto my said dear Wife All and singular my Household Goods and Furniture Stock in Trade and Effects ready Monies and Book Debts and all other my personal Estate whatsoever and of what nature or kind soever to and for her own use and benefit absolutely for ever. And from and after the Decease of my said Wife Catherine, then I do give and devise all my said Messuages or Dwelling Houses Hereditaments and Premises and real Estate unto my Niece Elizabeth Worrall Wife of Ishmael Worrall of Congleton aforesaid Tailr for an during the Term of her natural Life without the same being in any way liable to the Debts Controul [sic] or Engagements of her said present or any further Husband and her Receipt alone to be a sufficient Discharge for the Rents and profits thereof And subject thereto To the use and Behoof of ^all^ and every the Children of the said Elizabeth Worrall in such shares and proportions and in such manner and form and for such Estate and Estates Intents and purposes in my said real Estate as she the said Elizabeth Worrall shall by any Deed or Deeds Writing or Writings with or without Power of Revocation notwithstanding her Coverture and whether she be covert or sole or by her last Will in writing or any Writing or Appointment in the nature thereof shall limit, direct give devise or appoint and for want or in default of any such Limitation Direction Gift Devise or Appointment being made To the use and Behoof of all and every Children of the said Elizabeth Worrall equally as Tenants in Common and not as Jointenants And lastly I do hereby nominate and appoint my said Wife Catherine Cumberbirch and the said Ishmael Worrall Executrix and Executor of this my Will hereby revoking all former Wills by me made and do publish and declare this as and for my last Will and Testament in the presence of the Witnesses who subscribe their names in attestation hereof in my presence In Witness whereof I have hereunto set my Hand and Seal the tenth Day of November in the Year of our Lord one thousand eight hundred and fourteen [10 Nov 1814]

      Signed sealed published and declared by the said James Cumberbirch the Testator as and for his last Will and Testament, the Words “for ever” being first put in on the first side of this sheet and one interlineation and the words “equally as Tenants in Common” being first wrote on erasure on this side in the presence of us who at his request and in his presence and the the presence of each oher have set our names as Witnesses hereto

      The twenty ninth day of February 1820 Catherine Cumberbirch of Congleton in the Parish of Astbury & Co & Diocese of Chester Widow and Ishmael Worrall of Congleton in the Parish of Astbury & County & Diocese aforesaid Tailor the Executrix & Executor in this Will names were sworn in common form and they further made oath that the personal estate and effects of the Testator within the Diocese of Chester were under the value of One Hundred Pounds – before me J Hepinstall Surrogate
      The Testator died the fifth day of February 1820
