    • In the Name of God Amen I Phillip Johnson of Over Peover in the County of Chester ^Carpenter^ do make and Ordain this my last Will and testament in manner and form following, that is to say I will and direct that the clear Rents Issues and Profits of my Leasehold Estate in Lymm in the said County shall from and after my deceased be yearly paid and applyed by my Executor s hereinafter named to whom I give and devise the same In Trust to be paid and applyed in or towards the Discharge of the Mortgage Money that shall be due upon the same at the time of my Decease untill the said Mortgage money with the Accruing Interest thereof shall be thereby fully paid and discharged and from and after the Payment thereof I give and devise any said Leasehold Estate to my Daughter Mary wife of Benjamin Mostyn her heirs and Assigns for and during the continuance of the Lease thereof subject to the payment of a clear Annuity of Ten Pounds to my daughter Ann Bancroft wife of Thomas Bancroft her Heirs or Assigns during the continuance of the said Lease on the Twenty Fifth day of March and the Twenty Ninth Day of September yearly by equal portion without any Abatement for or in respect of any Taxes or other Charges whatsoever the first Payment thereof to be made on such of the said Days as shall happen next after the Payment of the said Mortgage money as aforesaid with which Annuity I hereby charge my said Leasehold Estate and will and direct that my said Daughter Ann her Heirs or Assigns shall have power to levy and raise the same when in Arrear by Distress on my said Leasehold Estate in such manner as Rent in Arrear can or may be lawfully distrained for and raised. And I give and bequeath all my Right and Interest in or to all that Messuage and Tenement with the Lands and Appurtenances thereto belonging in Over Knutsford in the said County heretofore in the possession of Robert Shaw and now of me or my Undertenants to my said Daughter Ann Bancroft and her Assigns until the said Mortgage money which shall be owing from or upon my said Leasehold Estate in Lymm shall be paid and discharged as aforesaid and after the payment thereof I give and devise the said Messuage and Tenement with the Appurtenances to all the Daughters of Thomas Goodwin deceased and Jane his Wife Sister of the said Robert Shaw for and during all my Estate and Interest therein upon Condition nevertheless that if John Goodwin Son of the said Thomas Goodwin and Jane his Wife who is now a Soldier shall be living after the said Mortgage Money shall be discharged then in such Case that the said John Goodwin shall enter upon and hold and enjoy one part of the said Messuage and Tenement to wit The Old House with half of the Orchard and one of the Lands in the Town Field from such time as he shall come in Person and demand the possession thereof. And I give and devise all that Messuage or Cottage and Tenement called the New House situate at the End of Peover Heath in Over Peover aforesaid which I hold by Lease under Sir Henry Mainwaring Baronet together with the Hilly Field and other the Lands and Appurtenances belonging to the same Messuage and Tenement or included in the said Lease thereof (except one third part of the Mossroom to be meered out at the South End thereof hereinafter disposed of) to Mary Johnson my Wife and her Assigns for and during her Natural Life if She so long continue a Widow and not remarryed. And I give and devise the same Messuage or Cottage Tenement and Premises of the said Mary my Wife and also all that my Messuage or Cottage and Tenement with the Appurtenances in Over Peover aforesaid called Bayley’s Cottage which I also hold under the said Sir Henry Mainwaring from and immediately after my Decease unto my Daughter Rebecca Johnson her Heirs and Assigns for and during the continuance of the said Leases of the same Messuages or Cottages and Tenements respectively. And I also give and devise to the said Rebecca my Daughter her Heirs and Assigns all the Benefit to which I am intitled in or to certain Lands in Over Peover aforesaid called Norbury’s for and during all my Estate and Interest in the same. And I give and devise all that my Messuage and Tenement with the Lands and Appurtenances thereto belonging situate lying and being in Over Peover aforesaid called the Back Lane Tenement now in my possession and which I hold by another Lease under the said Sir Henry Mainwaring to my son John Johnson his Heirs and Assigns for and during the Continuance of the said Lease thereof subject to the payment of the Mortgage money which shall be due or owing upon the same at the Time of my decease together with one third part of the Mossroom belonging to the said New House Tenement to be meered out at the South End thereof during the continuance of the Lease thereof. And I give and devise all that my Messuage and Tenement with the Lands and Appurtenances thereto belonging situate and being in Marthall in the said County to which I an intitled as Assignee from my late son William Johnson deceased the same having been parcel of a Tenement in Marthall aforesaid which the said William Johnson held by Lease under Samuel Egerton Esquire to my said Son John Johnson his Heirs and Assigns for and during all my Estate and Interest therein. And I will and direct that my said Messuage and Tenement in Marthall aforesaid which now stands Assigned as a collateral or further security for the money secured by Mortgage of my said Leasehold Estate in Lymm aforesaid shall be indemnifyed from the said Mortgage money by or out of the Rents and Profits of my said Leasehold Estate in Lymm aforesaid and that the clear Rents Issues and Profits of my said Messuage and Tenement in Marthall aforesaid shall during the minority of the said John Johnson my Son be applied by his Guardians in or towards the discharge of the principal money and Interest that shall be owing upon the Mortgage of the said Back Lane Tenement in Over Peover aforesaid Provided always and upon Condition that in case my said Son John Johnson and Daughter Rebecca Johnson my only Children by the said Mary my present Wife shall both of them happen to die under the Age of Twenty one Years and unmarried then and in such Case I give and devise all my said Leasehold Estates in Over Peover and Marthall aforesaid with my Interest in the said Norbury’s Lands to my said Daughters Mary Mostyn and Ann Bancroft their Heirs and Assigns for and during the Continuance of the said Leases thereof and all my Estates and Interest therein respectively (except only that the said Mary my wife shall in such Case hold and enjoy the said Messuage or Cottage and Tenement called Bayley’s Cottage during her Life and upon this further Condition that in case my said Daughter Mary shall die in the Life of my said Daughter Ann and either my Son John or Daughter Rebecca shall die unmarried and under the Age of Twenty one years Then I will and direct that my said Tenement in Marthall aforesaid shall go and I give and devise the same to my said Daughter Ann her Heirs and Assigns during the Continuance of the Lease thereof. And I will direct that all my Debts and Funeral Expences except the money secured by Mortgages as aforesaid shall be paid and discharged out of my Personal Estate and I give and bequeath all my working Tools Instruments used in the Business of a Carpenter together with my wearing apparel to my said Son John Johnson and all my Household Goods together with one milking Cow I give and bequeath to the said Mary my Wife and the said John and Rebecca my Son and Daughter and I will and direct that all the Residue of my Personal Estate after the payment of my Debts and Funeral Expences (Except the said money secured by Mortgage as aforesaid) shall be applied towards the discharge of the money that shall be owing on the Mortgage of the said Messuage and Tenement called the Backlane Tenement in Over Peover aforesaid and I do hereby nominate Constitute the said Mary my Wife during her Widowhood and Charles Barker of Sandyway in the said County – yeoman Executors of this my Will and also Guardians of my said Son John Johnson and Daughter Rebecca Johnson during their minorityes respectively and hereby revoking all former Wills I do publish and declare this to be my last Will and Testament. In Witness whereof I the said Philip Johnson have hereunto Set my Hand and Seal this Eighth Day of November in the Thirty First year of the Reign of his Majesty King George the Second over Great Britan & in the year of our Lord One Thousand Seven hundred and Fifty Seven [8 Nov 1757]
